Rental Property Maintenance – Who is Responsible for What?

It is often unclear and uncertain who is responsible for what when it comes to the maintenance of a rental property. The usual assumption is that the landlord is responsible for all maintenance. However, this is not the case.

Who is responsible for what?

For one, the landlord is under no obligation to make any aesthetic upgrades during the lease.

Lordlords are, however, responsible for all structural maintenance, which includes the painting and maintenance of external walls, roofs and fixtures. This includes roof leaks and damp.

The landlord is also responsible for electrical wiring, plumbing, a fixed stove, the geyser, and electric fence, alarm systems, automatic gate motors and pool pumps, if applicable.

Any regular wear and tear that occurs is also the responsibility of the landlord.

Tenants responsibilities

The tenant must inform the landlord of any maintenance requirements in order for this to be addressed as soon as possible and avoid further damage.

Any damages caused by the tenant due to negligence are their responsibility to repair.

The tenant is also obligated to keep gutters and pipes clear. Any obstructions are therefore the tenant’s responsibility.

In order to avoid any disputes over maintenance, inspections should be done by  external contractors to ensure professional compliance and should include photos and printed documents signed by all parties on site at the inspection.
